*** April 15th, 2008 Deadline to Submit Comments ***
A public hearing is set for March 12 for input on judges up for retention in the fall election.

The hearing will be from 11:30 a.m. to 12:30 p.m. and 4:30 p.m. to 5:30 p.m. at the Hotel Arizona, 181 W. Broadway.

Written comments should be sent by April 15 to Commission on Judicial Performance Review, 1502 W. Washington, Suite 221, Phoenix, AZ, 85007-3231.

Arizona Supreme Court Justice W. Scott Bales and Court of Appeals Judge Garye L. Vasquez of Division II are included on the ballot.

Pima County Superior Court judges on the ballot are: Edgar B. Acuna, Gustavo Aragon Jr., Deborah Bernini, Carmine Cornelio, Jane L. Eikleberry, Patricia Escher, Richard S. Fields, Howard Hantman, Jan E. Kearney, Virginia C. Kelly, Kenneth Lee, John S. Leonardo, Leslie B. Miller, Michael O. Miller, Clark W. Munger, Charles S. Sabalos, Sarah R. Simmons, Paul E. Tang, Stephen C. Villarreal and Natalie Warner.

The Arizona Commission on Judicial Performance surveys litigants, witnesses, jurors, people who represented themselves in court, staff and attorneys who appeared before Superior Court judges last year.

The commission's findings will be published in the Secretary of State's Voter Pamphlet before the 2008 general election Nov. 4.

1. Is there a recall petition associated with this effort?

No, a petition is not being circulated. Under Arizona law, all Superior Court Judges are added to the ballot each General Election year to determine if they'll be retained. Simply by voting "No" to retain, if the majority of the votes is "No" to retain, the judge is supposed to be removed from the bench.

2. Why don't you file a complaint with the Arizona Judicial Performance Review Board?

Waste of time. The Arizona Judicial Performance Review Board has proven by their actions that their primary interest is to protect judges instead of providing judicial integrity. Seeing as the judges are lawyers and the people on the Performance Review Board are lawyers, as anticipated, these lawyers stick together and they won't turn on one another. Moreover, the Arizona Judicial Performance Review Board is nothing more than a rubber stamp organization and they are guided by the very judges they profess to regulate.

3. Doesn't the Arizona Judicial Performance Review Board already post ratings on Arizona Judges?

Yes, they do but these results are skewed. The Arizona Judicial Performance Review Board is an extremely black box organization and they filter out what the public sees and doesn't see so they have the power to manipulate the ratings however they deem necessary. In the spring of 2005, the Arizona Judicial Performance Review Board went through a massive and expensive exercise to give the appearance they'll be changing the amount of information given to the public on the complaints filed against judges. In the end, they'll release the complaints; however, they'll assign the judge a number so whoever views this information will have no way of knowing which judge was complained against. Moreover, they won't release any complaints they deem unfounded which by the way is the majority of the complaints. The Reader's Digest version: the Arizona Judicial Performance Review Board threw the general public a bone when in reality the end result is business as usual.

First of all, on November 4th, 2008 during the General Election, you can check NO when you're asked whether or not to retain Judge Clark W. Munger. Secondly, you can tell your friends about this web site by clicking on the above "E-mail this page to a Friend" image. Last but not least, you can print out the Vote No Judge Munger Car Sign and you can place it in the rear window of your vehicle.

You can also contact the local news media and hopefully, they'll write an article on Judge Munger. 7. Why did you setup this web site and what do you have against the Hon. Clark W. Munger?

In my opinion, I feel he has no business being a judge. Under the U.S. Constitution, everyone has the right to represent themselves in a court of law that is unless you're in Judge Munger's courtroom. Judge Munger has a history of treating pro se litigants unjust, unfairly and rudely. Seeing as he's lawyer, it'll become evident if you're in his courtroom that he only caters to people like himself -- e.g., fellow attorneys. You'll see a sample of his actions in this article. Not surprisingly, you'll see the comments in this article by the Arizona Judicial Performance Review Board that they'll give her comments some serious consideration. Naturally, this was nothing more than lip service since they did nothing. What's even more shocking is that he's not only a judge but he's the presiding judge. How they could promote someone like this is beyond me. Alas, not all is lost, simply vote no on Vote No Judge Munger Day and hopefully they'll appoint a new judge who has better integrity.

8. What happens if I don't show up for a court appearance set by Judge Munger?

He'll more than likely issue a warrant for your arrest. Before he was a judge, he failed to show up for a court appearance on a traffic ticket so he doesn't practice what he preaches. About the time I setup this web site, the Arizona Supreme Courts public access to court records mysteriously removed the failure to appear information from the record. Luckily, I saved a copy before they removed this information. Failure to appear must run in the family since his brother, John Munger, has done it twice (Court 1, Court 2) and he'll probably do it a third time (Court 3) with the photo radar received on 11/14/2007.
